WORKSAFE GUIDE FOR DEVELOPING A WORKPLACE DRUG & ALCOHOL POLICY

Employees who are unfit for work place themselves and others at risk of harm. WorkSafe Victoria offers guidance to employers in establishing a workplace alcohol and other drugs policy. Having a clear policy ensures a consistent approach and may reduce injuries, inefficiency, absenteeism, and lost time and production.

An employer’s duty under s.21 of the OHS Act requires that they provide and maintain a safe and healthy work environment for their employees, and contractor employees. Employers also have a duty under s. 35 of the Act to consult with employees when developing policy and procedures about health and safety matters.

The hazards and risks associated with alcohol or drug impairment in the workplace should be assessed in the same way as any other hazards and risks – identify the hazards, assess the risk, control the risk, and review the effectiveness of those controls. Consultation must take place at every step of the risk management process.

Employers should follow these steps to develop a workplace alcohol and other drug policy –

  • Establish a representative group to formulate and implement the policy
  • Develop the policy in consultation with employees
  • Provide information, education and training

It is important to clarify procedures for identifying employees who appear to be impaired to avoid hesitance and uncertainty. A properly trained designated person should be identified who can approach employees when there is concern about their fitness for work, and the procedures should address escalation in situations where initial contact results in a negative or hostile response.

Other points to consider are work sponsored functions where alcohol may be consumed, counselling and discipline options, employee assistance programs (EAPs), testing regimes, and privacy and confidentiality.
