In July 2022, a worker whose sleeve was caught on length of protruding REO bar was dragged into a machine. He was flipped over the ‘REO bar threading machine’ onto the floor with his arm twisted backward. The worker’s injuries were serious and multiple: a broken right leg, a broken left forearm, a dislocated elbow, broken ribs and lacerations to his forehead, eye and ear. He underwent two surgeries and was in hospital for a significant length of time.
The company, Nexsa Pty Ltd, a structural prefabrication manufacturer of products including REO bars located in Sunshine North, pleaded guilty. It accepted that it had failed in its duties under Act by not installing interlocked guarding to cover all moving components of the plant, a ‘hold-to-run’ pedal control, and an emergency stop button.
The company pleaded guilty and was, with conviction, fined $50,000 and &4,918 in costs. The Court would have convicted and fined the company $100,000 had it not been for the guilty plea.
