SECOND COMPANY CHARGED AFTER GARBAGE TRUCK FATALITY

WorkSafe has charged Beyond AG Pty Ltd (trading as Bardee) for the death of their 26-year-old employee who was killed in an incident in Hosier Lane in June 2023. Charges have also been laid against another company, Mad Diesel Repairs Pty Ltd, as previously reported in SafetyNet.

The food waste collection company employee died when the truck he was operating rolled forward and pinned him against a post and a building wall in Hosier Lane.

Following their investigation, WorkSafe has charged Beyond AG with two charges - one under s.21(1) of the OHS Act for failing to provide and maintain a safe workplace, and one under s.23(1) of the OHS Act for failing to ensure that people other than workers are not exposed to risks arising from the conduct of the work.

It is alleged that the company failed to reduce the risk of injury or death by failing to have in place a safe system of work which required daily checks of the truck’s parking brake, the reporting of faults and timely assessment and repair of faults.
