ENFORCEABLE UNDERTAKING FOR TRAFFIC MANAGEMENT FAILURE

McConnell Dowell Constructors (Aust) Pty Ltd (MCDC) was a principal contractor working on the Level Crossing Removal Project. On two separate occasions MCDC employee were injured in incidents involving traffic management issues and collision with plant.

Each incident resulted in prosecutions for breaches of the OHS Act. All charges were withdrawn following an Enforceable Undertaking being entered into by MCDC which includes seven undertakings at an estimated cost of $1,254,708. 

The seven undertakings include – 

  • Fit out MCD and key subcontractor plant with Blindsight AI plant and people separation technology 
  • Investment in Virtual Reality Technology to address People and Plant Separation Risks 
  • Development of an industry wide 'Safe Sites' video campaign 
  • Funding the development and use of a digital vehicle and pedestrian management plan software 
  • Development of audit tool addressing psychosocial risks for use by industry 
  • Scholarship for Master of Applied Science (Built Environment) by Research 
  • Donations to SHINe and Women in Safety 

The undertaking has been accepted by WorkSafe and will be monitored for compliance.
