OHS reps - Your Rights

What is a health and safety representative?

An OHS rep is a person elected by the workers to represent them on any and all OHS matters. A rep is how workers can Speak Up Together on OHS. To be an effective rep, you must be supported by your members. And a good rep listens to and consults with their members.

Rights of a rep

The right to be consulted the employer BEFORE:
  • any changes to the workplace, the plant, the substances or the systems of work;
  • taking action on hazards
  • developing training plans
  • hiring OHS consultants
  • undertaking workplace monitoring
  • WorkSafe Inspectors enter the workplace for any reason.

So workers' concerns are understood

The right to CONSULT:

  • Members of their DWG
  • Other OHS reps
  • The union
  • WorkSafe
WHY?
So you know what you're talking about!

The right to participate in meetings:

  • with your DWG members
  • with other reps to caucus on all OHS matters. This may be reps from the same employer, from the same workplace but different employers (eg labour hire, contractors), or a network of reps across the local area or an industry sector.
  • of the health and safety committee
WHY?
So that your members know what's going on and you are not operating on your own.

The right to inspect the workplace and investigate
WHY?

So that you can identify hazards and risks and do something about it.

The right to take action on OHS matters.
WHY?

So that you can make your employer comply with the law.

The right to attend approved training courses of choice
WHY?

So that you receive union based training - the best training!

The right to information
WHY?

Because information is essential for effective consultation.

The right to facilities - eg phone, internet, photocopier, filing cabinet, etc 
WHY?

So that you have the tools to support you in your role

The right to time to do all the above!
WHY? So that you can be an effective OHS Rep!
